Welcome to ArkRose Marketing! These Terms of Service(“Terms”) govern your access to and use of our website arkrosemarketing.com (the “Site”) and our services. By accessing or using our Site and services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Site or services.
1. Services
ArkRose Marketing provides review management and digital marketing services (“Services”). By subscribing to our Services, you agree to use them in accordance with these Terms and any additional agreements or guidelines provided to you.
2. User Accounts
- Eligibility: You must be at least 18 years old to use our Services.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Payment and Subscriptions
- Pricing Plans: We offer two pricing plans: Do-It-Yourself Plan and Done-For-You Plan. Detailed descriptions of each plan are available on our Pricing page.
- Payments: All payments are processed securely through Stripe. You agree to provide accurate billing information and authorize us to charge your payment method for the agreed-upon fees.
- Subscription Renewal: Subscriptions automatically renew unless canceled before the renewal date. You can manage or cancel your subscription through your account settings or by contacting us directly.
4. Refunds and Cancellations
- Refund Policy: Due to the nature of digital marketing services, we do not offer refunds once a service has been delivered or accessed.
- Cancellation: You may cancel your subscription at any time, but you will not receive a refund for any remaining period in your billing cycle. Canceled subscriptions will continue until the end of the current billing period.
5. Use of Services
- License: We grant you a non-exclusive, non-transferable license to use our Services for your business purposes.
- Prohibited Use: You agree not to misuse our Services, including but not limited to, using them for unlawful activities, spamming, or violating any applicable laws.
6. Intellectual Property
- All content, software, and materials provided by ArkRose Marketing and Climbo, including logos, designs, and text, are the intellectual property of ArkRose Marketing and or Climbo. You may not reproduce, distribute, or create derivative works without our express permission.
7. Limitation of Liability
- ArkRose Marketing is not liable for any indirect, incidental, or consequential damages arising from your use of our Services. Our liability is limited to the amount you paid for the Services during the six months prior to the event giving rise to the claim.
8. Modifications to Services and Terms
- We reserve the right to modify or discontinue our Services at any time without notice. We also reserve the right to update these Terms, and any changes will be effective upon posting to our Site. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
9. Termination
- We reserve the right to suspend or terminate your access to our Services at our discretion, including for violations of these Terms or if we believe your actions may harm our business or other users.
10. Governing Law
- These Terms are governed by the laws of Minnesota United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Minnesota
